New Submission Addresses Human Rights and the Climate Emergency


Following the successful inauguration of its Inter-American Human Rights Observatory, the Facts and Norms Institute (FNI) has made another significant stride by submitting its second Amicus Curiae Memorial to the Inter-American Court of Human Rights. Authored by Monique Salerno, Julia Muinhos de Paula, and Gabriela Cavalieri Maia, this Memorial addresses the intricate connections between human rights and the climate emergency. In an era where climate change poses an existential threat to humanity, FNI's Memorial underscores the essential link between environmental stewardship and the protection of fundamental human rights. Submitted on December 18, 2023, the document argues the necessity for States to adopt proactive measures in preventing and mitigating the effects of climate change, in alignment with the obligations set forth by the Inter-American Convention and the global mandate as articulated in the Paris Agreement. It emphasizes the need for states to adopt differentiated measures for vulnerable populations, reflecting on the Brazilian perspective through legislation and jurisprudence. By examining Brazil's legal and policy responses to climate change, the Memorial critiques gaps and suggests improvements, highlighting the critical role of national frameworks in advancing climate action and human rights protection. It also delves into the environmental and human rights jurisprudence of the Inter-American Court of Human Rights, advocating for stronger enforcement mechanisms and accountability for states. The document emphasizes the necessity for states to adopt proactive measures in regulating, monitoring, and mitigating activities that exacerbate the climate emergency, alongside ensuring access to environmental information and justice for all communities, especially those most at risk.

This latest submission by FNI to the Inter-American Court of Human Rights serves as a continuation of the Institute's dedicated efforts to contribute to the Inter-American Human Rights System.
